Restaurant owner gets hammered by copyright heavies
Tuesday, October 10, 2006
In a week that has seen all the Major Record Labels do multi million dollar deals with startup and copyright bender youtube.com. With Google picking up the company for a mere $1.65Billion... With the rich corporates planning out their consilidated Star Trek future. Spare a thought for this fella.
Michael Dorr the 37 year old owner of the Oregon restaurant Imbibe has had a federal lawsuit dropped on his head (along with an ACME Anvil). A rep from the American Society of Musicians and Publishers paid an unannounced visit to his restaurant one night and heard covers of the songs performed by local band Black Notes. Not realising he had a live perfomance licence but not the correct one for covers, and it never had been an issue.
The American Society of Musicians and Publishers report there findings and the estates of Jimi Hendrix classic, "The Wind Cries Mary," and Stevie Wonder's "That Girl," are suing for copyright infringement - and they're seeking payment of between $750 and $30,000 for each song, along with attorney fees.
Michael Dorr had to say a few things.
"It's basically going to bankrupt me and put me out of business,"
"I can't afford the lawyer and the fees. It's going to close me down."
"It's a total bummer,"
"It's scary for me and my family. The restaurant business is hard and on top of other things, business is slow. This is the icing on the cake."
